- ACCEPTANCE OF TERMS
By accessing or using Gordon-Conwell Theological Seminary’s MinistryList.com (the “Platform”) in any manner, including browsing or viewing job postings without creating an account, by clicking “I Agree,” or by submitting, posting, or applying to any professional ministry position on the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as they may be updated from time to time. Your continued use of the Platform following any changes constitutes acceptance of those changes.
- JOB POSTERS – REPRESENTATIONS AND OBLIGATIONS
By posting a position, you represent and warrant that:
2.1 Authorization and Organizational Status
- You are an authorized representative of a church, religious organization, or nonprofit ministry organization with legal authority to bind that organization to these Terms.
- Your organization is a legitimate entity operating in compliance with all applicable federal, state, and local laws.
2.2 Religious Alignment
- Your organization understands that Gordon-Conwell Theological Seminary is a Protestant evangelical institution operating under Title VII’s religious organization exemption (42 U.S.C. § 2000e-1), which permits religious organizations to prefer employees of a particular religion.
- Your posted position aligns with a similar evangelical theological perspective consistent with Gordon-Conwell’s Statement of Faith.
- If your organization does not identify as evangelical, it affirms a Trinitarian understanding of God (Father, Son, and Holy Spirit as coequal persons).
2.3 Accuracy and Compliance
- All information provided in your posting is true, accurate, complete, and current.
- Your posting and hiring practices comply with all applicable employment laws, including but not limited to Title VII of the Civil Rights Act, the Americans with Disabilities Act, the Age Discrimination in Employment Act, and state and local employment regulations.
- Your posting does not contain false, misleading, defamatory, or discriminatory content prohibited by applicable law.
- You will promptly remove postings once positions are filled.
2.4 Platform Understanding
- MinistryList.com is a free service provided as a courtesy by Gordon-Conwell Theological Seminary.
- All postings are subject to administrative review and approval prior to publication, which may take 1–3 business days.
- Job postings may be removed at any time, at the sole discretion of MinistryList.com administrators, including but not limited to postings that violate these Terms or applicable law.
- Job postings will be automatically removed after 6 months unless you respond to an automated email notification within 2 weeks to request an extension.
- APPLICANTS – REPRESENTATIONS AND LIMITATIONS
3.1 Service Limitations
- MinistryList.com serves exclusively as a job-listing platform. Gordon-Conwell Theological Seminary does not participate in, influence, or control the hiring, selection, interviewing, or employment process of any posting organization.
- All job-related inquiries, applications, and communications should be directed exclusively to the hiring organization.
3.2 No Guarantees
- Gordon-Conwell Theological Seminary makes no representations or warranties regarding the accuracy, completeness, availability, legitimacy, or outcomes of any posted positions.
- Inclusion of a posting on MinistryList.com does not constitute endorsement, recommendation, or verification by Gordon-Conwell Theological Seminary of the posting organization or opportunity.
3.3 Applicant Due Diligence
- You are solely responsible for conducting your own investigation and due diligence regarding organizations, opportunities, and positions listed on the Platform.
- You acknowledge that you are voluntarily applying to positions with religious organizations that may exercise religious preferences in employment consistent with applicable law.
- INDEMNIFICATION
4.1 Job Poster Indemnification
You agree to indemnify, defend, and hold harmless Gordon-Conwell Theological Seminary, its trustees, officers, employees, agents, and affiliates from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees and court costs) arising from or relating to: (a) your job posting content; (b) your hiring, selection, or employment practices; (c) your breach of these Terms; (d) your violation of any law or regulation; or (e) your infringement of any third-party rights.
4.2 Applicant Indemnification
You agree to indemnify, defend, and hold harmless Gordon-Conwell Theological Seminary, its trustees, officers, employees, agents, and affiliates from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees and court costs) arising from or relating to: (a) your use of the Platform; (b) your application materials or communications with posting organizations; (c) your breach of these Terms; or (d) your violation of any law or regulation.
- LIMITATION OF LIABILITY
5.1 Disclaimer of Warranties
The platform is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
5.2 Exclusion of Damages
In no event shall Gordon-Conwell Theological Seminary be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or business interruption, arising from your use of or inability to use the platform, even if advised of the possibility of such damages.
- DATA PRIVACY AND PROTECTION
6.1 Privacy Policy
Your use of the Platform is also governed by Gordon-Conwell’s Privacy Policy, which is incorporated by reference into these Terms.
6.2 Job Poster Data Obligations
Job posters acknowledge that they may receive personal information from applicants and agree to: (a) use such information solely for legitimate employment purposes; (b) maintain appropriate security measures to protect applicant data; (c) comply with all applicable data protection and privacy laws; and (d) not share, sell, or distribute applicant information to third parties except as necessary for the hiring process.
- TERMINATION AND ENFORCEMENT
Gordon-Conwell Theological Seminary reserves the right, in its sole discretion, to: (a) suspend or terminate your access to the Platform at any time for any reason, including violation of these Terms; (b) remove any posting that violates these Terms or applicable law; (c) investigate suspected violations of these Terms; and (d) take any legal action deemed appropriate.
- GENERAL PROVISIONS
8.1 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
8.2 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Gordon-Conwell Theological Seminary regarding the Platform and supersede all prior agreements and understandings.
8.3 No Waiver
Failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
